Terms of Service MARTINIEYEWEAR.IS - September 13, 2024
1. Definitions
1.1. Seller: VH group ehf., ID no. 580923-2670 (hereinafter referred to as "seller").
1.2. Buyer: The individual registered on the order confirmation (hereinafter referred to as "buyer").
1.3. Parties: Collectively, the buyer and the seller are referred to as the "parties".
2. About These Terms of Service
2.1. These terms apply to all purchases of goods and services made through the online store martinieyewear.is (hereinafter referred to as "the online store"), which is operated by the seller.
2.2. The seller reserves the right to amend these terms, whether in significant or minor ways, without prior notice.
2.3. Publication of new terms is considered sufficient when they are posted on the online store.
2.4. The buyer accepts the current terms by placing an order after the terms have been published, as stated in clause 2.3 of the terms.
2.5. Law no. 50/2000 on the sale of goods and customary practices in sales law shall apply to matters not specifically covered by these terms.
3. Pricing
3.1. Prices listed on the online store are in Icelandic Krona (ISK) and include VAT.
3.2. The seller reserves the right to change prices, whether by increase or decrease, and to offer discounts without prior notice or notification to customers.
3.3. The total cost of the order, including the price of the frame, the price of the chosen lenses, and shipping costs, will be displayed before the buyer confirms and pays for the order.
3.4. Purchases made at an obviously incorrect price, such as due to a typo or a system/software error, will be voided and not binding on the seller. Otherwise, the price shown on the order confirmation will apply, and neither party can claim payment for differences due to price increases or decreases.
3.5. Discount codes may be intended for the general public and/or specific groups of people. If an individual is found to misuse a discount code intended for a group they do not belong to, the seller reserves the right to cancel the purchase, and all payments will be refunded.
3.6. The discount code is entered after the buyer has accepted the terms and filled in all necessary information about themselves.
4. Payment Options
4.1. The buyer can choose to pay for their order through: TEYA/SALTPAY, AUR, or Netgíró. Payment cards from Mastercard and Visa can be used through both Aur and TEYA.
4.2. Order confirmation is contingent upon successful payment being made and received by the seller.
5. Delivery of Goods
5.1. Delivery of goods can only take place in Iceland.
5.2. Products are delivered through the delivery service DROPP. The buyer pays for the shipping unless otherwise agreed, and the buyer can choose from selected delivery locations offered by DROPP, which are displayed when completing the order on bluelight.is.
5.3. The seller reserves up to 6 weeks for delivery of custom orders if the seller does not have the required frames or lenses in stock. Generally, custom orders should be delivered within 3-4 weeks.
5.4. If the product ordered by the buyer is out of stock with the seller's supplier, the buyer can choose to receive a full refund or a store credit if preferred.
6. Defective Products
6.1. If a product is defective, it must be returned to the seller as per clause 7.2 as soon as possible for inspection. If the seller confirms the defect, the buyer can choose between a refund or a replacement of the same product.
7. Return and Refund Policy
7.1. Custom-ordered products, such as prescription glasses and sunglasses, cannot be returned unless they are defective. Other products can be returned within 14 days from the date of delivery. The product must be unused, in perfect condition, and in undamaged packaging.
7.2. Products must be returned to the nearest DROPP delivery location. Return instructions can be found on the DROPP website at https://www.dropp.is/voruskil. The buyer is responsible for all return costs unless the product is defective.
7.3. Upon returning a product, the buyer will receive a store credit for the amount originally paid for the product.
7.4. The store credit is valid for one year from the date of issuance and cannot be used for discounts or sale items.
8. Processing of Personal Data
8.1. The seller pledges full confidentiality regarding any personal information provided by the buyer in connection with the transaction.
8.2. The buyer authorizes the seller to collect and process personal data for marketing purposes.
8.3. Personal data will not be disclosed to third parties under any circumstances.
8.4. The seller does not store any card information, and all payments are processed through secure gateways TEYA and/or AUR.
8.5. The seller handles all personal data in accordance with law no. 77/2000 on data protection and handling of personal information.
9. Jurisdiction
9.1. The provisions of these terms shall be interpreted in accordance with Icelandic law. Any disputes arising from the transaction shall be brought before the District Court of Reykjanes.
